What is the IID program?
IID stands for Ignition Interlock Device. Any vehicle equipped with IID requires an alcohol-free breath sample for the ignition to engage. The IID is set at .03 to allow for potential mouth alcohol from mouthwash, etc.
Who pays for the IID?
The offender pays the fees related to the IID program. The cost is $70 for installation and $75 per month for monitoring.
Are DMV administrative hearings required if an offender pleads guilty to a First Offense Election (FOE)?
No, one condition of the FOE plea is that the offender withdraw from the DMV administrative hearing. However, if an offender shows up for a scheduled DMV administrative hearing, DMV does not check the conviction status – the hearing will proceed as scheduled.
Why do 1st time offenders sometimes seem confused about why they've been referred to Outpatient Treatment instead of the Education program?
All offenders are evaluated and referred to the level of care deemed appropriate as a result of the evaluation. Each potential referral is reviewed by a clinical supervisor for concurrence. There are times when the clinical supervisor overrides the counselor's initial decision. The client is not notified until the clinical supervisor makes this determination.
How long can a client expect to wait for an evaluation once the initial call is made?
Currently, the wait time is about two weeks. This can vary per county, and can depend on the case load at a given point in time.
Ten business days does not always seem like enough time for a client to contact DERP for an evaluation. Why was this time frame chosen?
Individual courts have varying time frame information provided in their sentencing documents. The JP Court system gives 72 hours, the CCP system requires the evaluation be completed within 28 days. If the client has not scheduled an appointment within 10 days, it is unlikely their evaluation will be completed within 28 days. Please remember, the new DUI Tracking System receives the offenders conviction on the same date that the court clerk enters it into CJIS. The clock starts on that date.
When offenders are sentenced to jail time, they cannot contact DERP within 10 days. What can we do to prevent offenders from receiving a non-compliance discharge?
If DERP is notified by the offender or by the Probation Officer, an administrative discharge can be entered. This effectively stops the clock until the offender is released and able to make contact.
Clients often complain the phone lines at DERP are busy or that they have a long wait when they get through. Why does this happen?
DERP has 8 incoming lines, 3 of which are funneled into the CSR's in the DUI services section. It takes an average of 10 minutes to process a DUI client. Often, the 1-800 line is busier than the toll lines. It is suggested to try the toll line if unable to get through on the 1-800 line. It is also suggested to call in the late afternoon or early evening hours, as the call volume is lower during those times.
If the offender is not referred to DERP by the court, should the Probation Officer process a paper referral?
The goal of the tracking system is to reduce the use of paper as often as possible. We recognize this will not always be possible. In the event the court has not processed the referral electronically, Bonnie Stark suggested saving a document from DACS and attaching that document to an email to DERP. You can forward those emails to sstachoni@sodatdelaware.com.
How do out-of-state DUI provider agencies know what documentation is required?
DERP provides a list of requirements to both the offender and the out-of-state agency. DERP also suggests the offender retain copies of everything they receive from the out-of-state agency in the event that agency fails to return the correct paperwork to DERP.
Is there a comments field in the DUI Tracking System?
There is a “comments” field on every screen in the tracking system. Probation Officers have access to enter comments on the “Charge” screen of the system. Please note, when first opening a screen, all comments in the “comments” field will be hidden from view (to save screen space). The user must click “show comments” to view this field.
What can clients with a financial hardship do?
Clients can request a payment plan if they can demonstrate financial need. Documentation is required and all reasonable requests will be considered.
Does the treatment agency face legal liability for satisfactorily completing a client who then reoffends?
The treatment agency never makes the claim that a particular client will not reoffend. Rather, they indicate the client has made progress in dealing with their addiction or dependency and have a good prognosis for recovery. In addition, the client completes a “DUI Avoidance Plan” and thus has a plan in place to help avoid recidivating.
How does alcohol tolerance factor into diagnosis?
Higher tolerance is always considered, as an increased tolerance demonstrates long-term use or abuse. In addition, clients with higher tolerance levels are at risk for withdrawal symptoms that could require medical help.
